Terms and Conditions

The terms governing your use of Utilify, including data collection, consent, and your rights under Alberta's Personal Information Protection Act.

Agreement to Terms

By creating a Utilify account or continuing to use the platform after we post changes, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, you must stop using Utilify and delete your account.

When you register, we ask for your express consent via a checkbox. When we make material changes to these Terms, we will notify you through an in-app prompt and require your renewed acceptance before you can continue using the service.

Description of Service

Utilify is a web-based utility bill analysis platform. You upload utility bills (PDF or image format), and we extract, categorize, and visualize your charges and consumption data to help you understand your utility spending.

We do not provide financial, legal, or energy consulting advice. Bill analysis is automated and may contain errors — always verify important figures against your original bills.

Account Registration and Security

To use Utilify, you must create an account with a valid email address and password. You are responsible for:

  • Keeping your login credentials confidential
  • All activity that occurs under your account
  • Notifying us promptly if you suspect unauthorized access

We enforce single-session access — signing in on a new device ends your previous session.

Collection of Personal Information

We collect the following categories of personal information, as defined under Alberta’s Personal Information Protection Act (PIPA, SA 2003, c P-6.5):

Information you provide directly:

  • Full name and email address (at registration)
  • Password (stored only as a cryptographic hash — we never store or access your plaintext password)

Information extracted from your uploaded bills:

  • Full name and home or service address
  • Utility account numbers
  • Amounts owed, payment history, and billing dates
  • Energy and utility consumption figures

Information collected automatically:

  • IP address, browser type, and operating system
  • Pages visited and actions taken within the platform
  • Session identifiers (authentication cookies)

This information is collected for the purposes identified in the next section, in accordance with PIPA Section 11.

Express consent. When you create an account, you provide express consent to the collection, use, and disclosure of your personal information as described in these Terms and our Privacy Policy. This includes sensitive information such as your home address, financial data, and consumption patterns extracted from your uploaded bills.

Implied consent. For operational data that is necessary to run the service — such as server logs, IP addresses, and session cookies — your consent is implied through your use of the platform.

Withdrawing consent. Under PIPA Section 9, you may withdraw your consent at any time by contacting us or deleting your account. If you withdraw consent, we will stop collecting and using your personal information, but:

  • We may retain certain information as required by law or for legitimate business purposes (e.g., fraud prevention records)
  • You will no longer be able to use Utilify, as the service requires processing your personal information to function
  • Withdrawal does not affect the lawfulness of processing carried out before withdrawal

Use of Your Information

We use your personal information only for the purposes stated here, in accordance with PIPA Section 16:

  • Service delivery — Parsing, analyzing, and displaying your utility bill data
  • Account management — Authentication, session management, email notifications you have configured
  • Service improvement — Analyzing aggregate usage patterns to improve parsing accuracy and the user experience
  • Security — Detecting and preventing fraud, abuse, and unauthorized access
  • Legal compliance — Responding to lawful requests from government authorities

We do not use your personal information for advertising, profiling, or automated decision-making that produces legal effects.

Disclosure to Third Parties

We do not sell your personal information. We disclose information only in the following circumstances:

Aggregate statistical data. We may share aggregated, non-identifying statistics (such as average utility costs by region or seasonal consumption trends) with third parties including government bodies, researchers, and industry partners. These reports contain no individual-level data and cannot be used to identify you.

Government and public body partnerships. We may share anonymized and aggregated data with government bodies (such as the Alberta Utilities Commission, municipal energy programs, or provincial agencies) to support public interest initiatives including energy efficiency research, rate analysis, and policy development. No individual records are shared — only aggregate statistical summaries.

Compelled disclosure. We will disclose your personal information if required to do so by law, court order, or a valid request from a government authority with lawful jurisdiction. Where permitted by law, we will notify you of such a request.

Service providers. We use a limited number of service providers to operate Utilify (e.g., cloud hosting, email delivery). These providers process your data only on our behalf, under contractual obligations to protect it, and only to the extent necessary to provide their services.

Data Retention and Storage

Your data is stored on servers located in Canada. Uploaded bill documents and extracted data are encrypted at rest.

We retain your personal information for as long as your account is active. When you delete your account:

  • Your profile, bill data, and uploaded documents are deleted within 30 days
  • Anonymized aggregate data derived from your information (which cannot identify you) may be retained indefinitely
  • Backup copies are purged according to our standard backup rotation (up to 90 days)
  • Records required for legal compliance may be retained as required by applicable law

Your Rights Under Alberta PIPA

Under Alberta’s Personal Information Protection Act, you have the right to:

  • Access — Request access to the personal information we hold about you (PIPA Section 24)
  • Correction — Request correction of inaccurate personal information (PIPA Section 36)
  • Withdrawal of consent — Withdraw your consent to the collection, use, or disclosure of your personal information (PIPA Section 9), subject to the limitations described in the Consent section above
  • Deletion — Request deletion of your account and associated personal information
  • Portability — Request your data in a portable, machine-readable format

To exercise any of these rights, get in touch. We will respond within 45 days as required by PIPA.

Filing a complaint. If you believe we have not handled your personal information in accordance with PIPA, you may file a complaint with the Office of the Information and Privacy Commissioner of Alberta:

Limitation of Liability

Utilify is provided “as is” without warranty of any kind, express or implied. We do not guarantee the accuracy, completeness, or reliability of bill analysis results.

To the maximum extent permitted by applicable law:

  • We are not liable for decisions you make based on data displayed by Utilify
  • Our total liability for any claim arising from your use of the service is limited to the fees you have paid us in the 12 months preceding the claim (or $100 CAD, whichever is greater)
  • We are not liable for indirect, incidental, special, consequential, or punitive damages

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable Alberta law.

Changes to These Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the “Effective date” and version identifier at the top of this page
  • We will notify you through an in-app prompt requiring your acceptance before you can continue using the service
  • We will update the Privacy Policy if the changes affect how we handle your personal information

Your continued use of Utilify after accepting updated Terms constitutes your agreement to the revised Terms.

Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of Utilify shall be subject to the exclusive jurisdiction of the courts of Alberta.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
